Terms of Service

1. Acceptance of Terms

By creating an account or using Playbook Memories (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

2. Eligibility

You must be at least 18 years old to create an account on Playbook Memories. By creating an account, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

If you are creating athlete profiles for minors (children under 18), you must be the parent or legal guardian of those minors and have the authority to consent to their data being included in the App.

Player logins: The App lets you create a separate player login so your child can sign in and take part. The 18-and-over requirement above applies to creating an account, not to using a player login you have created for your own child. By creating a player login you confirm you are that child's parent or legal guardian, you consent to the App collecting the information they enter, and you remain responsible for their use of the App. You can reset or revoke a player login at any time. See the Children's Privacy section of our Privacy Policy for what a player login can do.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Ensuring the accuracy of information you provide.
• Notifying us immediately of any unauthorized use of your account.

You may not share your own account credentials with others or allow others to sign in as you. Creating a player login for your child, or inviting a family member to join your account with their own credentials, is not account sharing — those are supported features of the App.

4. Acceptable Use

You agree to use Playbook Memories only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity.
• Upload content that infringes on the intellectual property rights of others.
• Harass, bully, or harm other users or their families.
• Use the App to promote or engage in any illegal activities.
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems.
• Use automated tools (bots, scrapers) to access the App without our permission.
• Interfere with or disrupt the App or servers connected to the App.

5. Content Ownership and License

Your Content: You retain all ownership rights to the content you upload to Playbook Memories, including photos, videos, game logs, and reflections ("User Content").

By uploading User Content, you grant Playbook Memories a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and display your User Content solely for the purpose of providing the App's services to you and your family.

Our Content: All other content on the App, including the design, layout, features, and software, is owned by Playbook Memories and is protected by copyright, trademark, and other intellectual property laws.

6. User-Generated Content

You are solely responsible for the content you upload to the App. We do not review all User Content before it is posted, but we reserve the right to remove any content that violates these Terms or is otherwise objectionable.

We are not responsible for User Content posted by other users. If you encounter content that violates these Terms, please report it to us at legal@playbookmemories.com.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.

8. Subscriptions and Payments

Playbook Memories may offer subscription plans for premium features. If you purchase a subscription:

• You will be charged the subscription fee at the beginning of each billing period (monthly, seasonal, or annual).
• Subscriptions automatically renew unless you cancel before the renewal date.
• You can cancel your subscription at any time through your account settings or the app store where you purchased it.
• Refunds are handled according to the app store's refund policy (Apple App Store or Google Play Store).
• We reserve the right to change subscription pricing with advance notice.

9. Termination

By You: You may delete your account at any time through the App settings. Your sign-in is removed immediately and cannot be restored; we finish removing your personal data within 30 days, except for records we are required by law to retain. If other people share your account, the account and its contents are kept for them — see Deleting Your Account and Data in our Privacy Policy for exactly what is removed.

By Us: We may suspend or terminate your account if you violate these Terms, engage in illegal activity, or for any other reason at our discretion. We will provide notice when reasonably possible.

Upon termination, you will lose access to your account and all associated data. We are not liable for any loss of data resulting from termination.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The App will be available at all times or without interruption.
• The App will be error-free or free of viruses or other harmful components.
• Any content or features will meet your expectations.
• AI-generated content (encouragement, reflections) will always be accurate or appropriate.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYBOOK MEMORIES AND ITS OWNERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF THESE TERMS OR YOUR USE OF THE APP WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRIOR TO THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify and hold harmless Playbook Memories, its owners, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any rights of another person or entity.
• Any User Content you upload to the App.

13. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App will be resolved in the courts of Calgary, Alberta.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting a notice in the App or by email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Playbook Memories regarding your use of the App and supersede all prior agreements.
